The Employment and Equality Tribunal has dismissed a claim for constructive unfair dismissal brought against the Department of Education, Sport and Culture.
It ruled that Juan Moore was nearly five months outside the legal time limit.
Mr Moore, who represented himself, argued that several factors delayed his claim, including an ongoing grievance process, assurances from the department, and new evidence from an investigation.
However, Chairperson Peter Scott stated: “The fact that a grievance process was ongoing is not a sufficient reason to extend the time for filing the claim.”
