The Deputy High Bailiff has criticised the lack of suitable provision for a vulnerable adult who she was forced to remand in custody.
The man in his 20s appeared before Rachael Braidwood on Tuesday.
Advocate Paul Glover, who is representing the man, said that it was agreed that prison is “clearly” not the place for him, but he has nowhere else to go.
Ms Braidwood agreed, saying: “I cannot fathom how there is nowhere for Mr X to go given his is vulnerable person.”
The Deputy High Bailiff also made reference to an occasion where the man, who has no fixed abode, was offered a sleeping bag and a tent, but did not detail when this happened or who offered them to him.
Asking that probation officer appear before the court for his next appearance, Ms Braidwood said she needs a “further explanation as to why my hands are tied”.
She added: ‘I am not happy and it is not satisfactory… it is a highly unsatisfactory situation.”
Both Ms Braidwood and Mr Glover expressed concern that if the man remains in prison his sentence would be completed before probations services were able to work with him, which they said would be “setting him up to fail”.
The case was adjourned until September 24, with the man remanded in custody until that date.
