A property investment director has been awarded over £90,000 by an employment tribunal.
Bryan Gareth Chatwin succeeded in claims for unpaid salary and holiday pay but failed in his claim of constructive unfair dismissal against Captima Ltd.
The Employment and Equality Tribunal ruled that Mr Chatwin was owed £87,240.41 in unpaid salary from July 2022 to September 2023, plus £2,876.80 for accrued but untaken holiday pay.
An additional £2,160 was awarded under Section 25(4)(c) of the Employment Act 2006.
Resigning
The tribunal heard that Mr Chatwin had not been paid for over a year, save for one month in October 2022.
Despite this, he continued working until resigning in September 2023 after a proposal to waive his salary in exchange for directors’ fees.
The tribunal found no fundamental breach by Captima, noting Mr Chatwin’s resignation was prompted by “the suggested waiver and the IoM Tax Office position,” which were not deemed breaches of contract.
