A public consultation has opened on the draft Code of Practice for the Capacity Act 2023, asking whether the guidance gives clear and practical support to those applying the law.
The Capacity Act sets out the framework for safeguarding the rights and wellbeing of people who may lack capacity to make decisions.
The Code explains how the Act should be used in practice, covering support for decision‑making, assessing capacity, best‑interests decisions, and the safeguards that apply when actions are taken under the Act.
It is aimed at families, carers, health and social care professionals, care providers and anyone involved in supporting people who may lack capacity.
The consultation seeks views on whether the guidance is accessible, accurate and workable. It is split into four parts, with the first three open to anyone and the fourth aimed at professionals and organisations. Respondents can answer only the sections relevant to their experience.
A revised Code is expected to return to Tynwald in November 2026, with the Act due to come into force in April 2027.
