A man convicted of dangerous driving on the Mountain Road has had his conviction quashed.
The appeal court found “the procedure adopted was wrong and unfair”.
Garry White was found guilty by the Summary Court on June 30 2025 following an incident on August 17 2024.
The court ruled that magistrates failed to hear the appellant’s submissions on the admissibility of video evidence.
The judgment stated: “It was just plain wrong that the Justices did not hear the Appellant’s submissions on the question of admissibility.”
Deemsters also criticised the admission of opinion evidence from police officers on whether the driving was dangerous, describing it as “demonstrably wrong”.
Mr White’s disqualification has been removed and the case will be retried before either the High Bailiff or his deputy.
