A man who stole a bottle of Apple Sourz and fought with the night manager of a petrol station will be sentenced in October.
David William Prescott, 37, of no fixed abode, admitted four offences when he appeared before the Deputy High Bailiff this week.
Prosecutor Barry Swain told the court that Prescott and two friends went into the EVF 24 hour garage on Peel Road at 1.50am on August 17.
As his friends were being served, Prescott helped himself to a bottle of Apple Sourz before leaving the store without paying.
This was seen on CCTV by the manager who was working in the backroom and followed him outside to retrieve the bottle.
With neither man willing to let go of the bottle, a scrap ensued where the two ended up on the floor, during the struggle Prescott was said to have punched and kicked the manage and bit him on the arm.
The Police then arrived and arrested Prescott who proceeded to call a female officer the C word and a “daft b*tch” before making threats that he knew where she lived.
Cell Damage
Once at Police HQ Presott tried to flush a pillow down the toilet, thereby flooding his cell, which later cost £150 to clean.
He then gave a no-comment interview to all questions asked.
His advocate Paul Glover said his client did kick the manager of the store while they were on the floor, but that he was holding his leg at the time and said it was not a forceful kick as if he was standing up.
Mr Glover asked for a full social enquiry report to be conducted before Prescott is sentenced and recommended Deputy High Bailiff Rachael Braidwood view the store’s CCTV before sentencing.
He will be sentenced for damaging the cell, using threatening or abusive language, theft and common assault on October 15.
