Only one respondent to the Department for Enterprise’s consultation on annual leave and rest breaks raised concerns about workplace searches.
In response to a written Tynwald question, Enterprise Minister Tim Johnston said the reference appears on page 11 of the Department’s published review of consultation responses, and no further assessment has been carried out at this stage.
He said the Department’s current focus is on implementing the Employment (Amendment) Act 2026, which introduces new statutory rights including Neonatal Care Leave and Carer’s Leave, and on developing regulations for Shared Parental Leave and Parental Bereavement Leave.
Mr Johnston noted that the legal position on employee searches in the Isle of Man mirrors that of the UK, with no specific statutory prohibition.
Searches, drug testing and other forms of monitoring are governed by individual company policies.
Employees who believe a search has breached those policies are advised to raise the matter with their employer or seek guidance from the Manx Industrial Relations Service.
