A claim of unfair dismissal brought by a former Department of Infrastructure worker has been ruled out of time.
Aleksander Nikolchev’s claim was dismissed by the Employment and Equality Tribunal for being submitted outside the legal time limit.
Mr Nikolchev’s employment ended on June 29 2025. However, his complaint was not received by the tribunal until October 9, over three months later.
Chairman Douglas Stewart stated the tribunal’s consistent approach was that a claim must be lodged within three months, unless it was “not reasonably practicable” to do so.
He found Mr Nikolchev had not met this burden.
Mr Stewart said: “Even if the Claimant is only one day late, if it was reasonably practicable to lodge the Claim within the three-month period, the law is against admitting such a Claim to proceed.”
With no evidence the complaint was filed in time, the tribunal ruled it had no jurisdiction to hear the case.
