Commissioners Ordered to Reprocess FOI

Castletown Commissioners has been ordered to reprocess a Freedom of Information request after the Information Commissioner found multiple failings in how the authority handled it.

The request, submitted in October 2025, sought quarterly accounts, payment details, ledger codes and related correspondence.

While some information was released, the authority withheld large sections without initially citing exemptions, later relying on incorrect UK legislation before issuing a corrected response.

In her decision, Dr Alexandra Delaney‑Bhattacharya found the authority breached the 20 day response deadline, failed to evidence adequate searches, and did not justify several exemptions.

She also noted that key documents were not provided for review, preventing verification of whether exemptions, such as those relating to personal data or commercial interests, were correctly applied.

The Commissioners must now either disclose the information or issue a fully compliant refusal notice within 30 days. The applicant retains the right to seek a further review.
