Complaint Made Out of Time

An employment tribunal has ruled it has no jurisdiction to hear an unfair dismissal complaint against Manx Utilities.

It found that Stuart Brew’s complaint was submitted after the statutory deadline.

Mr Brew was dismissed on August 12 2025. His complaint form, dated November 7 was received by the tribunal on November 19, missing the November 11 cut-off.

In his decision, the Chairman said: “There was no need for Mr Brew to have left presentation to the last minute when it had been reasonably practicable throughout the three-month period to have presented the complaint form in time.”

He concluded that it was “reasonably practicable” for Mr Brew to have submitted his claim within the three-month limit.

The tribunal found Mr Brew’s uncertainty over the deadline’s start date and his decision to post the form days before it expired, did not justify an extension.
