The Information Commissioner has ordered Douglas Council to revisit an FoI request concerning building control inspections at the former Nurses Home development.
Dr Alexandra Delaney-Bhattacharya found the council had applied a “blanket exemption” without proper justification .
The applicant had sought details of site visits, asbestos containment decisions and certification related to green loan conditions at the MDC development.
The council refused to provide the information, citing the “Economy and commercial interests” exemption and claiming publication would reveal trade secrets.
In a decision notice issued on 26 February, the Information Commissioner found the authority had failed to assess whether the exemption applied to each piece of information individually and had not conducted a required public interest test.
Dr Delaney-Bhattacharya given the council 30 days to either disclose the information or issue a fresh refusal notice.
