DoI Tribunal Ruled Out of Time

The Employment and Equality Tribunal has dismissed a complaint against the DoI over an alleged unlawful wage deduction.

It ruled that James Drinkwater’s complaint was field too late.

The dispute centred on a £2,880.49 deduction made in November 2024, recalculating “substitution pay” after Mr Drinkwater’s backdated pay rise.

The Tribunal noted claims for unlawful deductions must be filed within three months, by 28 February 2025, but Drinkwater lodged his complaint on 23 April 2025.

Deputy Chairperson John Wright said: “I find the Complaint was brought out of time without reasonable grounds.

“I do not exercise my discretion to extend time as there are no relevant matters to take into account. The Complaint is not therefore admissible.”
