A man has been fined after admitting assault causing actual bodily harm when he bit a woman during an incident described as “slightly bizarre” by a prosecutor.
Kane Andrew Damien Bibby, 23, of Colby, was sentenced by magistrates at Douglas Courthouse.
Prosecutor Barry Swain said that on the night of June 25 2023, Bibby was drunk in Port St Mary and said to be in a distressed state.
A woman he knew saw him and she and her friend invited them into their flat where he calmed down before making advances on one of the women, which were rejected.
Mr Swaine said in a “slightly bizarre” set of circumstances, the complainant ended up on top of Bibby as he was lay on the floor, with a video of the incident showing him struggling and shouting.
In his basis of plea, Bibby said the woman leant over him, at which point he bit her on the breast leaving what Mr Swain said was a “rather nasty bruise”.
Bibby said he had been acting in self-defence, but upon reflection, he accepted he “went over the top”.
For her part, the complainant said Bibby had “seemed unstable” and had no reason to bite her, which she said was “very painful”.
In sentencing Bibby, magistrates said he had “come close to going to prison”, but agreed with the recommendation from probation that a suspended sentence and compensation was a better course of action.
They handed Bibby an 18 month suspended sentence, with probation, and ordered him to pay £300 in compensation to the woman he bit.
He must also pay £300 in court costs which reflect his decision to plead guilty before the case reached a trial.
