The Information Commissioner has issued a stinging condemnation of Manx Care after the health body failed to address data protection issues.
This is the second notice issued by the Information Commissioner in four years after a very similar complaint was raised in 2021.
Commissioner Dr Alexandra Delaney-Bhattacharya noted “systemic failures” in handling public data requests, with some waiting four months for information that should be provided within four weeks.
This is largely the the same issue that prompted the original 2021 notice, since when Dr Delaney-Bhattacharya said Manx Care has “failed to evidence that they have introduced improvements to the compliance of their subject access request processing as mandated”
She also found that search methods remain “poorly focussed, unreasonable and insufficient”.
Unnecessary
The report highlights how the health service continues to make unnecessary demands for identification documents and fails to implement proper record-keeping systems, despite these being key issues in the original enforcement.
Dr Delaney-Bhattacharya warned: “If the right of access is not improved following this Enforcement Notice, the Commissioner will consider regulatory action that may result in a monetary penalty.”
