Manx Utilities Authority (MUA) Chair John Wannenburgh has defended the body’s use of non-disclosure agreements (NDAs).
The Douglas North MHK said the use of NDAs is “infrequent” and largely commercial, during this week’s Tynwald sitting.
Mr Wannenburgh confirmed 17 NDAs are in place, most at the request of external partners.
“NDAs are governed by legal principles, local law, and contract law on the Isle of Man,” he said, adding they must comply with the Data Protection Act 2018 and cannot override whistleblowing rights.
Julie Edge challenged the secrecy, stating: “I find it very concerning that 17 NDAs are active within the organisation.”
She pressed Wannenburgh to confirm no employee had been barred from reporting concerns. He replied: “Due process is followed in every occasion.”
Tim Glover called for transparency on costs, something which Mr Wannenburgh agreed to, saying: “I have no problem in agreeing to do that.”
The chairman emphasised MUA’s adherence to the government’s updated whistleblowing policy, effective since April 1.
The session closed with unresolved questions about enforcement and commercial partners, which Mr Wannenburgh pledged to address.
