The Information Commissioner has required the Financial Services Authority to re-process a Freedom of Information request after finding that a personal data exemption was misapplied.
The FOI request asked the FSA to provide its organisational chart, staff names, and the maximum salary for each role, including those of the Chief Executive and board members.
In its response, the FSA released an organisational chart along with some job titles, names, and top salaries.
Withheld Information
However, it withheld the names and salary information of most staff by relying on a personal data exemption. Notably, this exemption was also applied to the Chief Executive’s maximum salary.
Following a review, the Information Commissioner concluded that the personal data exemption had been misapplied in at least one instance and should be reconsidered in others.
As a result, the Commissioner has instructed the FSA to re-process the FOI request and issue a new response.
