An employment tribunal has rejected an application to proceed with a claim of constructive unfair dismissal against the Department of Education Sport and Culture.
It ruled that Juan Moore had filed his claim nearly five months after the legal deadline.
Mr Moore, who represented himself, argued that multiple factors delayed his claim, including an ongoing grievance process, assurances from the Department of Education, Sport and Culture and new evidence from an investigation.
He also cited work-related stress and bereavement.
Chairperson Peter Scott agreed that the tribunal has power to permit a claim to be presented outside the three-month limit, however, he concluded that Mr Moore failed to prove it was “not reasonably feasible” to file on time.
The tribunal noted Mr Moore was aware of the grievance outcome by October 2024 and sought advice from the Manx Industrial Relations Service in November but did not act promptly.
Mr Scott said, “There is no reason why the Claimant could not have issued proceedings within the time limit and then have them adjourned until the grievance had been concluded.”
