Tribunal Rules For Estate Agent

An estate agent has been awarded £6,006 by an Employment Tribunal following unlawful deductions from her pay.

Emma Clarke, who worked for Partners Limited after its acquisition of Plum Properties in December 2024, claimed she was owed commission at a rate of 7.5% on sales she had introduced.

The tribunal heard her employment ended on May 31 2025, but an agreement entitled her to continued commission on certain sales until December 31 2025.

The company, which did not attend the final hearing, had its last-minute adjournment request refused.

Chairman Douglas Stewart said the application was “not necessitated by any act or omission of another party” and found “no exceptional circumstances:,

The tribunal found that the core dispute was “not on whether there could be no unlawful deduction claim advanced but as to the rate of commission”.

It rejected the respondent’s argument that the rate was 5%, upholding Ms. Clarke’s claim for 7.5%.

The £6,006 award comprises £3,846 in unpaid commission and a £2,160 compensatory award.

A further part of Ms Clarke’s claim, concerning commission on three specific properties, was adjourned pending further disclosure from Partners Limited.
