A claim against Peel City Diner Limited for unlawful deductions and a failure to provide a written statement of terms has been dismissed by the Employment and Equality Tribunal.
The case concerned employee Nicole Smith, who worked for the business from April 2021 until July 2025.
The tribunal heard that while outstanding wages for her final week of employment were paid and settled before the hearing, a dispute remained over the notification of a change in her employer from Jolly Good Catering Company Limited to Peel City Diner Limited in November 2024.
Address
The Respondent’s representative, Phillip McCarthy, confirmed that a letter detailing the change was sent to her provided address.
Ms Smith maintained that the letter was not received and was unaware of the change until seeing two employers listed on her tax return.
In her decision, Chairperson Felicity Kniveton said: “The Respondent appears to have been a reasonable employer and it’s company and employers records were kept in good order and I find the allegations in respect of the letter and/or the alleged detriment to be ill founded.”
The tribunal found Ms Smith was aware of a change, which she believed was a simple name change and could have sought further information.
The complaint was dismissed in its entirety.
